Bad faith use is one of the UDRP conditions for the transfer of a name. The panels' view on this notion of use seems to have evolved in the recent months.
I have been invited to give a talk during the SedoPro Partner Forum 2008 (thanks!), and thought it would be interesting to study this recent evolution, focusing on generic names. I post below the slides I used.
